Service Agreement
This Agreement is made effective as of the date Of Signing of Estimate/Invoice between Client/Customer Listed On Estimate/Invoice and Automation & Security Services, of P.O. Box 1205, Hephzibah, Georgia 30815.
In this Agreement, the party who is contracting to receive services shall be referred to as "Client/Customer", and the party who will be providing the services shall be referred to as "Automation & Security". Automation & Security has a background in Network & Electronics Installation and is willing to provide services to said Client based on Their accumulated background. Client desires to have services provided by Automation & Security Service. Set fourth by acceptance, in the form of signature and/or payment upon Estimate/invoice. Estimate/invoice Shall Be Defined as document submitted to client /customer labeled "Invoice" or" Estimate" Listing Services or Prices or both.
Therefore, the parties agree as follows:
Signing of Estimate / Invoice - The Signing of estimate/Invoices is from that point a binding Legal agreement in which Automation and security agrees to supply the parts and labor listed on the Estimate/Invoice for the amount shown. All items and labor not listed are not included for that price. For additional parts or labor a Change order must be signed. The Estimate may also be signed by emailing “Approved” back to automationandsecurity@gmail.com with the Estimate Attached.
Change Order - A change order must be signed to vary from original signed Estimate/Invoice. Additional labor charges for required labor not accounted for on the original invoice/estimate
Change Of Circumstance - If during the course of a job, unforeseen circumstances arise that though no fault of Automation and Security causes the job to change in price, Applicability or legitimacy, Client must pay Automation and security for services rendered From start of job though date of written notice to cease work on Job
EXPENSE REIMBURSEMENT. Automation & Security Service shall be entitled to reimbursement from said Client for all "out-of-pocket" expenses to include stop payments or returned checks. Legal fees should Client refuse to pay will be paid by Client to Automation & Security Service.
DESCRIPTION OF SERVICES - Beginning on Date of signing, Automation & Security will provide the following services (collectively, the "Services"): Stated On Estimate/Invoice to only include services covered under our States License.
PERFORMANCE OF SERVICES. The manner in which the Services are to be performed and the specific hours to be worked by Automation & Security Service shall be determined by Automation & Security Service. Said Client will rely on Automation & Security Service to work as many hours as may be reasonably necessary to fulfill Automation & Security Service obligations under this Agreement.
PAYMENT. Said Client will pay a fee to Automation & Security for the Services in the amount listed on Estimate/invoice not to include other unforeseen cost or equipment to the finial setup fees acquired. This fee shall be payable in full Within 10 Days of completion of the Services.
SUPPORT SERVICES - Said Client will provide the following support services for the benefit of Automation & Security Service should an out side contractor be needed for services unable to perform by Automation & Security Service due to limitations of our license. For a few Examples; High Voltage Wiring, Locksmith Services, Trenching.
NEW PROJECT APPROVAL. Automation & Security Service and Client recognize that services will include working on various projects for the installation of service. Automation & Security Service shall not obtain the approval of Client prior to the commencement of a new project so long as project is within the service of the installation of said contract service.
TERM/TERMINATION - This Agreement shall terminate automatically upon completion by Automation & Security Service of the Services and project required by this Agreement.
RELATIONSHIP OF PARTIES - It is understood by the parties that Automation & Security Service is an independent contractor with respect to Client and services to be perform will relate only to said agreement of this contract.
EMPLOYEES - Automation & Security Service employees, if any, who perform services for Client under this Agreement shall also be bound by the provisions of this Agreement.
ASSIGNMENT - Said Client’s obligations under this Agreement may not be assigned or transferred to any other person, firm, or corporation without the prior written consent from Automation & Security Service.
CONFIDENTIALITY - Automation & Security Service recognizes that Client has and will have the following information as to the security of each and every Client’s protection:
(a) Products, price, business affairs, process information, trade secrets, technical information, and copyrights and other proprietary information (collectively, "Information") which are valuable, special and unique assets of Client and need to be protected from improper disclosure. In consideration for the disclosure of the Information, Automation & Security Service agrees that all employees of Automation & Security Service will not at any time or in any manner, either directly or indirectly, use any information for Automation & Security Service own benefit, or divulge, disclose, or communicate in any manner any Information to any third party without the prior written consent of Client. Automation & Security Service will protect the Information and treat it as strictly confidential. A violation of this paragraph shall be a material violation of this Agreement.
DISCLOSURE - Automation & Security Service is required to disclose any information or questions Client may have in activities or interests of an employee or any one involved with project of installation of service. Automation will only produce records on jobs that are requested in the original estimate/Invoice agreement.
UNAUTHORIZED DISCLOSURE OF INFORMATION. If it appears that Automation & Security Service has disclosed (or has threatened to disclose) Information in violation of this Agreement other than Legal Services or a collection company, Client shall be entitled to an injunction to restrain Automation & Security Service from disclosing, in whole or in part, such Information, or from providing any services to any party to whom such Information has been disclosed or may be disclosed. Client shall not be prohibited by this provision from pursuing other remedies, including a claim for losses and damages.
CONFIDENTIALITY AFTER TERMINATION - The confidentiality provisions of this Agreement shall remain in full force and effect after the termination or conclusions of service of this Agreement.
ENTIRE AGREEMENT - This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.
AMENDMENT - This Agreement may be modified or amended if the amendment is made in writing and is signed by both parties.
SEVERABILITY - If any provision of this Agreement shall be Found to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
WAIVER OF CONTRACTUAL RIGHT - The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
APPLICABLE LAW - This Agreement shall be governed by the laws of the State of Georgia.
Service Calls And Hourly Service Rates - Our Basic Service Call Is $99.00 For Arrival On Site and up to the first 30 Minutes of time on site and $99.00 Each Additional Hour. the minimum charge is $99.00 unless previously discussed or quoted. We Charge For Parts used to Perform Requested service to your equipment. We order Parts Only Upon Written Request. We Charge For All Services Not Covered Under warranty from an original purchase.
Warranty
Labor
Residential - One Year From Start of Job on Labor to repair defective installation. Warranty only covers job as completed from original work performed. Changes to job after completion voids warranty on original job.
Commercial - One Year from notice of completion. Warranty only covers job as completed from original work performed. Changes to job after completion voids warranty on original job.
Parts - Manufacturer warranty on product. Warranty Starts When manufacturer Specifies. Check product Manufacturer website for terms for each product.
Jobs - As with all Security Systems, they are a plan put in place with a specific budget in mind. The Greater the budget the greater the protection. No System is a guarantee. Automation and Security does not warranty against loss due to the failure of equipment to perform its given task. Please test your systems monthly to confirm proper operation.
NOTICES - All notices required or permitted under this Agreement shall be in writing and shall be deemed delivered when delivered Via Email with return receipt verification, in person, or deposited in the United States Mail.

Our Basic $12.99 Monitoring Includes.
1 - Response of signals from your Alarm as Indicated By You On the Activation Form. You will be notified by our UL Listed Monitoring Station who is available 24/7 at (877) 206-9141 You may update this "Call list" at any time by letter, email or phone.
2 - Up to 100 signals sent per month sent to the monitoring station without possible additional charge.
3 - Local Support Available though email and by phone During normal business hours. Monday-Friday 7:30am ~ 5:00pm.

You must refer 10 Customers, by our records for Monitoring, All 10 must maintain their monitoring for the entire time you are monitored for free. You must call or indicate on your bill the customers name and that they were referred by you. This is very simple. I try eagerly to give people this discount. Confirm all your referrals.
